VIDEO: John Kennedy Asked A Biden Judicial Nominee What A Brady Motion Is. The Nominee Had No Clue.
Here’s something which ought to show you just how much ruin is afoot within the federal government under its current leadership, but if you’ve followed the Senate Judiciary Committee’s confirmation hearings over the past couple of years none of this will be much of a surprise to you.
You don’t have to be a lawyer to gain familiarity with the concept of a Brady motion. It refers to the case of Brady v. Maryland, a famous Supreme Court case from 1963 which established that in a criminal case, the prosecution must turn over all evidence that might exonerate the defendant (exculpatory evidence) to the defense.
If you’ve paid any attention at all to current events you’d be familiar with the concept, as it’s central to many of the January 6 cases, and in particular that of Jacob Chansley, the so-called QAnon Shaman, who’s been put under the jail on a 41-month sentence for “rioting” on that fateful day when video evidence never provided to Chansley’s defense team establishes that he never actually did anything illegal.
Chansley’s defense wasn’t made aware of the surveillance video which exonerates him. It’s a classic case where a Brady motion would change the outcome of a trial.
So you’d think somebody who was up for a federal judgeship would have material like this – which is first-year-of-law-school stuff it’s impossible to be qualified as a federal judge if you don’t know it – pretty close to the top of his mind.
And you’d be wrong.
The stumped nominee in question is S. Kato Crews, who’s currently a magistrate judge in Colorado being nominated by the Biden administration for a district court judgeship there. Crews is a stunning mediocrity being nominated for one reason and one reason only – he’s black, and Team Biden is doing everything it can to “diversify” the court system with as many nominees belong to racial minorities, women, LGBTQ Alphabet people and other interest groups friendly on balance to the Democrat Party.
He’s a magistrate judge and he doesn’t even know what a Brady motion is. It’s striking. He doesn’t even know what Brady v. Maryland was about; he thinks it’s a Second Amendment case.

The basic competence of federal judges is something we should be able to count on in a functional American society, and yet day after day in those Senate Judiciary hearings we see that Team Biden is actively, flagrantly disregarding it – solely in pursuit of woke racial bean-counting.
And this is happening at the same time we’re getting train derailments and bank failures and other disasters which are bright warning lights demonstrating how dangerous it is not to have competent people handling things.
It’s unacceptable, and it has to stop.
