
Judicial Sentencing Discrepancies Hit An Outrageous Low
Recently, a Nebraska Judge received a public reprimand after an incident in 2022. At that time, the Douglas County Juvenile Court Judge Candice Novak was frustrated by the fact that a juvenile who should have been in her courtroom didnโt show up.
In her frustration, Novak decided that since her time was being wasted, she would waste the lawyer’s time as well, so she held the court proceedings in limbo for about 90 minutes. During that time, she texted her staff about other court personnel and others who had appeared in her court, and many of those texts were not complimentary.
Some examples cited by the court included Novak referring to fellow juvenile court judges as a โbimboโ and a โpussy,โ and calling a county court administrator a โgooberโ and a former chief justice of the Nebraska Supreme Court a โdumb ass.โ
That story has nothing to do with the main point of this column, except for one thing that I will explain now.
I have written many times about liberal judges handing out disgustingly weak sentences to vile criminals, allowing them to get back on the streets where they can endanger the general public. However, I have never seen a more vivid example of liberal judicial stupidity than what took place recently in Nebraska.
Two Nebraska men were both convicted of raping the same 15-year-old boy. Both men were convicted of the same charges, sexual assault and producing child sexual abuse material. Both accepted the same plea deal, so everything for both men was exactly the same.
Douglas County District Court Judge Derek Vaughn sentenced Eric Bergstrom to 25-30 years, but then Vaughn was promoted to the Nebraska Supreme Court, leaving the sentencing duties for the other scum bag, Bradley Perry, to liberal horseโs ass Judge Rich McGowan, who then proceeded to sentence Perry to only 3 years!
Let that sink in.
Bergstrom will serve a minimum of 25 years in custody under Nebraskaโs good time law, while Perry will only serve 3.
Adding insult to injury, when McGowan was issuing his moronically low sentence, according to court transcripts, he said:
โJudge Vaughn is not here or available to make any decisions on Mr. Perryโs sentencing. I am the law. The governor has entrusted me to make this decision.โ
I am the law? Hereโs an idea: how about acting like it!
OK, so here is why I included the story about Judge Candice Novak. Every one of the names she called those other people should have been directed towards McGowan, because each applies to him and to what he thinks is justice.
Longtime Douglas County Attorney Don Kleine said the disparity is hard to ignore.
โI have respect for the judiciary, and I know how difficult their job can be. But this is a sentence that is far lower than it should be because it depreciates the seriousness of the crime. Every time you show or depict these people, youโre victimizing them again. Itโs horrible, and it deserves to be punished severely.โ
McGowan literally turned his back on the victim, and not only should Perry be punished much more severely, but this so-called judge also needs to be disbarred.
Kleine added, โWe think this is so far out of bounds it will get a good look at the Supreme Court and Court of Appeals.โ
Yes, it will, and it should. McGowanโs liberalism victimized a 15-year-old boy who had already suffered a life-altering attack by these two monsters. This is totally irresponsible, and it has to end.
